Events Release of Liability and Waiver of Rights

1. Assumption of Risk. You understand and voluntarily accept that participation in the Event involves inherent risks, including without limitation risks of illness, injury, property loss or damage, and other hazards that may arise before, during, or after the Event. You participate at your own risk.
2. Disclaimer of Liability. To the fullest extent permitted by applicable laws, Healthcare Information and Management Systems Society (“HIMSS”) and its affiliates, successors, assigns, sponsors, partners, officers, directors, employees, contractors, agents, and volunteers (collectively, the “Organizers”) disclaim all liability for any and all claims, losses, damages, injuries, liabilities, costs, or expenses of any kind (including, but not limited to, direct, indirect, general, special, punitive, incidental, or consequential damages) that you may suffer or incur in connection with your registration for, travel to or from, attendance at, or participation in any Event activity, whether occurring before, during, or after the Event, and whether arising from acts, omissions, or negligence of any person or otherwise.
3. Personal Property and Third-Party Services. You are solely responsible for your personal belongings. The Organizers are not responsible for, and disclaim any liability arising from, services provided by third parties, including without limitation transportation, lodging, venues, exhibitors, sponsors, or vendors.
4. Health and Safety. You agree to comply with all applicable laws and any health, safety, or security protocols issued by the Organizers or the venue. You are solely responsible for your own medical, travel, and personal insurance and expenses.
5. Release. To the fullest extent permitted by applicable law, you hereby release and discharge the Organizers from any and all claims now known or hereafter known or causes of action arising out of or related to your participation in the Event, except to the extent such release is prohibited by applicable law.
6. Covenant Not to Sue. You agree to not initiate any claim, lawsuit, court action, agency action, or other legal proceeding or demand against the Organizers, nor join or assist in the prosecution of any claim for money or other damages which anyone may have, on account of injuries (including death), losses, or damages sustained by you, other parties, or your (or others’) property in connection with your participation in the Event, and you waive any right you may have to do so. This means that you cannot sue to hold the Organizers responsible for any injury, loss, or damage sustained by you, other parties, or you (or others’) property in connection with the Event, even if it is due to the ordinary negligence, injudicious act, omission, or other fault of the Organizers.
7. No Warranty. The Event and all related content are provided “as is” without warranties of any kind, express or implied, including any warranty of fitness for a particular purpose or noninfringement.
8. Severability. If any provision of this disclaimer is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
